Definitely a war criminal. The man who turned a blind-eye and later supported a large-scale massacre of 3 MILLION East Pakistanis (now Bangladeshis), all in violation of US' own laws supported Pakistani military, moved the US 7th fleet to scare India, and later refused to offer an apology to the new Bangladesh nation. Many millions are pleased to see him gone!
